Effective August 3, 2026. These policies apply to our website, member app, booking tools, in-studio services, SMS, email, online classes, and livestreams. We may update policies by posting a revised version on this page.
These Terms of Service (“Terms”) govern your use of the websites, mobile web app, member portal, kiosk, online content library, livestreams, booking tools, and related services (the “Services”) operated by Hot Yoga and Wellness Center (“Studio,” “we,” “us,” or “our”).
By creating an account, booking a class, purchasing a membership or pass, checking in, viewing online content, joining a livestream, or using SMS/email features, you agree to these Terms, our Privacy Policy, and our SMS & Messaging Policy. If you do not agree, do not use the Services.
You must be able to form a binding contract under applicable law. If you book or create an account for a minor, you represent that you are their parent or legal guardian and that you accept responsibility for their participation, compliance with studio rules, and any required waiver or guardian consent.
You agree to provide accurate contact information (name, email, and, if you enable SMS, a mobile number you control). You are responsible for activity under your account and for keeping credentials confidential. Notify us promptly of unauthorized use. We may suspend accounts that appear compromised, abusive, or fraudulent.
We offer heated and non-heated yoga, fitness, and wellness classes. Heated practice may involve elevated room temperatures (typically about 95–100°F), physical exertion, sweat, and risk of injury or illness. The Services and class descriptions are not medical advice and do not create a patient–provider relationship. Consult a physician before beginning any exercise program, especially if you are pregnant, injured, recovering from illness, or managing a medical condition. You must complete any required Studio Waiver & Release before participating in-studio when we require it.
Follow instructor cues, hydrate, rest as needed, and leave the room if you feel unwell. Instructors may ask you to stop or modify practice for safety.
Class reservations, waitlists, check-in, and cancellations are subject to studio capacity and published policies, including any cancellation window shown on the site or in your account. Late cancels or no-shows may result in fees or loss of class credits when disclosed at purchase or in the membership agreement.

Prices are shown at checkout or on membership pages. Payment processing may be handled by third-party processors (for example, Stripe). You authorize us and our processors to charge the payment method on file for amounts you agree to, including memberships, packs, drop-ins, retail, workshops, and disclosed fees.
Auto-renewing memberships, if offered, disclose renewal price and interval at purchase. You may cancel future renewals as described in your account or by contacting the studio before the renewal date. Additional terms are in the Membership Agreement.
Except where required by law or expressly stated in a promotion, fees are generally non-refundable. Taxes may apply where required.
Online videos and livestreams are for personal, non-commercial use under your membership or purchase entitlements. You may not copy, redistribute, rebroadcast, publicly perform, or share login credentials. Live classes may be recorded for the online library when the host ends a session. See Online Content Terms.
We send transactional messages related to your account (for example: booking confirmations, waitlist updates, class reminders, password or magic-link sign-in, receipts, and service notices). These may be sent by email and, if you provide a mobile number and do not opt out of transactional SMS, by text message.
Marketing emails and texts (promotions, offers, newsletters) are sent only with your prior express consent. You may withdraw marketing consent anytime via account settings, unsubscribe links, or SMS STOP. Consent to marketing is not required to purchase or book classes.

You will not misuse the Services, attempt unauthorized access, scrape or overload systems, harass staff or members, record others without permission where prohibited, or use the platform for unlawful purposes. We may refuse service or remove content that violates these Terms or studio standards.
Studio branding, site design, class sequences as presented online, photos, video, and licensed content remain our property or that of our licensors. Your feedback may be used to improve the Services without obligation to you.
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” TO THE FULLEST EXTENT PERMITTED BY LAW. WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not guarantee uninterrupted availability of booking, payments, or online streams. Internet and mobile networks can fail; you are responsible for a safe practice environment when using online content.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE STUDIO AND ITS OWNERS, INSTRUCTORS, EMPLOYEES, AND PROVIDERS ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES OR PARTICIPATION IN CLASSES. LIABILITY FOR IN-STUDIO AND ONLINE PARTICIPATION IS FURTHER ADDRESSED IN THE WAIVER YOU ACCEPT. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE CASES OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT ALLOWED.
You agree to indemnify and hold harmless the Studio from claims arising out of your misuse of the Services, violation of these Terms, or infringement of others’ rights, except to the extent caused by our gross negligence or willful misconduct.
We may suspend or terminate accounts that violate these Terms or create risk to members or staff. You may close your account by contacting us; some records are retained as required for legal, tax, safety, or dispute purposes (see Privacy Policy).
We may update these Terms by posting a revised version on this page with a new effective date. Material changes to auto-renewal or paid services will be communicated as required by law.
These Terms are governed by the laws of the State of Ohio, without regard to conflict-of-law rules, except where consumer protections of your state of residence mandatorily apply. Venue for disputes that may be brought in court will lie in courts serving Montgomery County, Ohio, unless applicable law requires otherwise.
